Homecare Association response to proposed changes to legislation in Wales

We have responded to the Welsh Government's consultation "Proposed changes to legislation on social care and continuing health care".

In our response:

  • We raise concerns about the proposal to legislate to eliminate profit from the care of looked after children, and the impact this could have on provision. 
  • We welcome the use of direct payments for Continuing Health Care but highlight that, for these to work well, there needs to be a thriving market. So, issues with funding and workforce recruitment and retention in domiciliary care should be urgently addressed.
  • We raise some concerns about placing a mandatory reporting duty for children and adults at risk on individuals (rather than organisations). 
  • We question whether there may not be some technical issues for providers publishing their own annual returns.
